Senate Minority Leader Alan Peter Cayetano has filed his answer to the complaint for obstruction of justice lodged against him, accusing him of preventing the arrest of fellow Senator Ronald “Bato” dela Rosa. The Office of the Ombudsman confirmed this on Thursday. Cayetano’s counsel submitted the counter-affidavit on July 15. The counter-affidavit is in response to the ongoing preliminary investigation into the obstruction of justice complaint filed by opposition coalition Tindig Pilipinas and allied groups. The complainants allege that Cayetano, along with Senator Robin Padilla and then-Acting Senate Sergeant-at-Arms Mao Aplasca, placed Dela Rosa under “protective custody” to prevent his arrest on a warrant from the International Criminal Court (ICC) for alleged crimes against humanity during his term as police chief. Dela Rosa was placed under Senate protective custody after Cayetano was elected Senate President on May 11. The complainants claim this custody was a sham, followed by Aplasca firing warning shots at National Bureau of Investigation (NBI) agents, causing panic among Senate personnel, media, and civilians. Following the shooting incident on May 13, Senators Padilla and Dela Rosa were seen leaving the Senate premises together. “The acts complained of point to one purpose: to prevent, delay, or frustrate the apprehension of Dela Rosa and the investigation of his escape,” the complainants stated. They argue that a chain of events, from the grant of “protective custody” to the security response and the resistance to producing CCTV evidence, was directed at obstructing justice. The complainants believe these circumstances, coupled with existing evidence, establish prima facie evidence to indict the respondents for knowingly and willfully obstructing, impeding, frustrating, or delaying Dela Dela Rosa's apprehension and the investigation into his escape. Padilla has previously admitted that Dela Rosa “asked” to leave the Senate with him after the shooting incident and confirmed owning the vehicle seen departing the Senate, believed to be carrying Dela Rosa.
