Cambodia: Court Enforces Property Rights After Decade-Long Land Dispute

In Cambodia's southern Takeo province, a land ownership dispute that has been ongoing for over a decade has reached its conclusion with a court-ordered enforcement. The conflict began when creditor Ms. Ly Keao acquired the property through a court auction in 2018. Ms. Ly had agreed with the debtors, Mr. Rath Seng and his wife Ms. Prak Hon, to auction the property to settle the debt. However, even after Ms. Ly acquired the land through a set-off with the debt amount and legally obtained the immovable property ownership certificate (hard title), Mr. Rath and his wife continued to refuse to vacate the land. Reports indicate that the debtor couple had pledged the original ownership certificate, which had lost its legal validity, to a bank as collateral, further complicating the situation. The dispute had been prolonged since 2015, when the debt to Ms. Ly was reportedly incurred, with no legal resolution in sight. Following an enforcement order from the Takeo Provincial Court, specialized authorities visited the site to take possession of the disputed property and ordered the occupants to vacate. Prior to the forced execution, the court and prosecution had granted the debtors a 15-day grace period for voluntary evacuation and demolition of structures, but as this was not fulfilled within the deadline, the enforcement proceeded. For Ms. Ly Keao, this enforcement signifies the realization of justice after nearly nine years since acquiring ownership through the court auction, holding significance beyond mere repossession of the land. This case underscores the importance of the effective enforcement of court judgments and orders, emphasizing that rights recognized through legal procedures should not be lost due to non-compliance with court decisions.
