Marcoleta seeks vote recognition in impeachment proceedings

MANILA, Philippines — Senator Rodante Marcoleta has submitted a letter of manifestation to the Senate impeachment court, asking to have his vote considered in the proceedings. This is according to Senator-Judge and presiding officer Francis “Chiz” Escudero who announced receipt of Marcoleta’s letter during the seventh day of Vice President Sara Duterte’s impeachment trial. According to Escudero, Marcoleta in his manifestation cited a rule, supposedly made during the impeachment trial of former President Joseph Estrada, which allowed senators who cannot vote in person to still be able to do so. “During the Estrada impeachment trial, a rule was adopted—which we are confirming—that allows the Senate president to provide a mechanism by which a senator who cannot vote under any unavoidable circumstances [can] cast his vote on any matter,” said Escudero. However, Escudero referred the matter to the Senate, this time as a legislative body, given that it is the upper chamber that can amend the rules of the impeachment court. “Since this impinges upon the rules of the impeachment court, this matter should be properly taken up by the Senate as a legislative body,” said Escudero. “And whatever decision the Senate will have as a legislative body, the court shall implement it,” he added. Despite this, Escudero expressed that he was “inclined to agree” with Marcoleta’s suggestion, so long as he does not face any suspension. Marcoleta is currently facing non-bailable plunder charges before the Sandiganbayan, and is currently detained at the New Quezon City Jail. /jpv
