Comelec Mandates Conflict of Interest Declaration in COCs

MANILA, Philippines — The Commission on Elections (Comelec) has approved the inclusion of a sworn declaration of conflict of interest in the certificate of candidacy (COC). This new requirement compels candidates to pledge that they will not engage in financial or pecuniary interests that could be affected by the performance of their official duties upon election. The decision, formalized in a memorandum dated August 4, stems from a recommendation by Comelec's Law Department during a July 24 referendum. The undertaking requires candidates to commit to complying with Republic Acts 3019 (Anti-Graft and Corrupt Practices Act) and 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees). Specifically, candidates must declare their adherence to the prohibition against having direct or indirect financial or pecuniary interests in any business, contract, or transaction that may be influenced by their official duties. The Law Department clarified that these are not new conditions but rather an affirmation of existing legal obligations. The primary aim of this declaration is to foster transparency and ensure that candidates are officially on record regarding potential conflicts of interest that could arise if they are elected. Comelec cited its authority under Section 52(g) of the Omnibus Election Code, which empowers the commission to prescribe election forms, as the basis for this addition. This move is seen as an effort to enhance the ethical standards and integrity of public officials in the Philippines. While provisions against conflict of interest have long existed, mandating a clear declaration at the candidacy stage is intended to strengthen their enforceability and provide voters with greater assurance regarding the candidates' commitment to impartial governance.
