Indonesian legal experts have stated that losses incurred in business activities do not, in themselves, automatically constitute a criminal offense. This issue has emerged from concerns that losses resulting from business misjudgments or market fluctuations could be construed as malicious acts. Experts point out that for business losses to be subject to criminal penalties, the existence of clear intentional and illegal acts, such as fraud or embezzlement, is a prerequisite. The general view within the legal community is that simple business judgment errors or losses due to unforeseeable external factors should not lead to criminal liability. This clarification is considered to have significant implications for enhancing the transparency of Indonesia's business environment and promoting domestic and foreign investment.
