This development reflects the complex challenges ASEAN faces: safeguarding data sovereignty in the rapidly expanding digital economy while simultaneously promoting economic growth through technological innovation. Vietnam, as a key ASEAN member, is prioritizing the development of its digital economy and has been strengthening its legal framework for data protection and cybersecurity. However, the rise of global digital platforms and the increasing cross-border flow of data highlight the difficulties nations face in controlling data. In an era where algorithms significantly influence decision-making and information dissemination, their opacity can heighten risks of unfairness and privacy violations. The inclusion of an algorithmic clause in the ASEAN digital agreement could potentially enable member states to demand certain disclosure obligations regarding algorithm operations and measures to prevent unfair discrimination or bias. This could be a crucial step for countries like Vietnam in enhancing the reliability of their digital infrastructure and creating an environment where citizens can use digital services with confidence. Nevertheless, the challenges of keeping regulations abreast of rapid technological innovation and disparities in technological and economic capabilities among member states may affect the agreement's effectiveness.
