Comelec Exempts LTFRB Fuel Subsidy from Election Spending Ban

The Commission on Elections (Comelec) has exempted the fuel subsidy program of the Land Transportation Franchising and Regulatory Board (LTFRB) from the ban on public spending for social services, allowing its continued distribution ahead of the Barangay and Sangguniang Kabataan Elections (BSKE) on November 2. Comelec Chairperson George Garcia confirmed the exemption for the LTFRB's fuel subsidy, stating it is covered under social services. This exemption also extends to the Libreng Sakay (free ride) program and monthly assistance under the Public Transport Modernization Program. However, the distribution of social assistance under other programs such as TUPAD (Emergency Employment Program), AKAP (Drivers and Dispatchers Assistance Program), AICS (Assistance to Individuals in Crisis Situation), and 4Ps (Pantawid Pamilyang Pilipino Program) remains prohibited from October 23 to November 2, with the exception of medical and burial assistance. The poll body also stipulated that elective officials, candidates, nominees, and aspirants are prohibited from being present during the distribution of social aid under these programs. The LTFRB is mandated to adhere to guidelines set by the Department of Social Welfare and Development (DSWD), Department of Labor and Employment (DOLE), and other relevant agencies during its aid distribution. Violations may lead to the revocation of the certificate of exemption. The LTFRB had previously suspended the distribution of the P12-per-liter fuel subsidy for public utility vehicle (PUV) drivers due to the election ban. The prohibition on public fund disbursement is in effect from September 18 to November 2, coinciding with the BSKE. During an election period, a certificate of exemption is issued to a government agency to permit specific activities that would otherwise fall under the election ban, such as releasing or disbursing public funds for social welfare, housing, or infrastructure projects, and transporting firearms. This exemption is crucial for public transport drivers who are often heavily impacted by fluctuating fuel prices, a common concern in the Philippines given its reliance on imported oil and susceptibility to global market volatility. Ensuring the continuity of such subsidies can help stabilize their income and prevent significant fare hikes, thereby mitigating broader economic effects on commuters. The decision reflects a balancing act by the Comelec between upholding election integrity and addressing the immediate economic needs of a vital sector.
