Indonesia's Agrarian Reform Law Aims for Legal Certainty and Social Justice

Indonesia's Agrarian Reform Law (Undang-Undang Reforma Agraria, hereinafter UU Reforma Agraria) has been enacted, marking a significant step towards achieving legal certainty and social justice regarding land in the country. This law is expected to shed light on resolving the complex land ownership issues and disputes over land use that Indonesian society has grappled with for many years. Specifically, it aims to improve the welfare of all citizens by promoting land registration, clarifying ownership rights, and facilitating equitable land distribution. From a social justice perspective, improving access to land for smallholder farmers and indigenous communities, particularly in rural areas, is considered crucial. The enactment of UU Reforma Agraria demonstrates the Indonesian government's commitment to sustainable development and the building of an inclusive society. However, its effectiveness will largely depend on the specific implementing regulations of the law, its execution at the local government level, and coordination among stakeholders. The speed and transparency of land ownership transfer and registration processes, as well as how existing land disputes are addressed, will be key to gaining public trust going forward. In Indonesia, the demand for land continues to rise with population growth and advancing urbanization. Under these circumstances, there is significant domestic and international attention on how UU Reforma Agraria will contribute to balancing economic development with social equity.
