Cambodia and the United States are demonstrating divergent views on international justice mechanisms, particularly concerning the roles of the International Court of Justice (ICJ) and the International Criminal Court (ICC). Cambodia emphasizes its proactive use of the ICJ to resolve border disputes peacefully and legally. Historically, Cambodia brought the Preah Vihear Temple territorial dispute to the ICJ in 1959, with a 1962 ruling affirming Cambodian sovereignty. In 2013, the ICJ further clarified this judgment. In 2025, Cambodia initiated new proceedings at the ICJ concerning disputed areas along its border with Thailand, underscoring its policy of relying on international law as an alternative to military force. Conversely, the United States harbors significant concerns regarding the ICC's jurisdiction. Official reports from February 6, 2025, indicate that the then-Trump administration imposed sanctions, including asset freezes and visa bans, on ICC officials involved in investigations concerning the US. This stems from fears that US involvement in conflicts, particularly in the Middle East, could lead to ICC scrutiny. Analysts suggest that US support for the ICC is conditional, often aligning with its own geopolitical interests. Cambodia became a state party to the Rome Statute, establishing the ICC, in 2002.
