SC Considers House Arrest, Compassionate Release to Ease Jail Congestion

The Supreme Court (SC) is considering measures such as house arrest and compassionate release to address the severe congestion problem in jails across the Philippines. Chief Justice Alexander Gesmundo announced this at the Justice Sector Coordinating Council (JSCC) Summit. According to Chief Justice Gesmundo, the SC is revising its rules and procedures concerning detention and release for persons deprived of liberty (PDL). These revisions will include provisions for house arrest, medical confinement, or community-supervised release. Additionally, a section on "compassionate release" for offenders who are elderly, sick, or otherwise entitled to humanitarian release upon serving their minimum term will be incorporated. Gesmundo emphasized that justice should be a tangible reality in people's lives, not just a concept. He pointed out that jail congestion is not the sole responsibility of one agency but reflects systemic challenges throughout the entire justice pipeline, from investigation and prosecution to case resolution, detention record-keeping, and the execution of release orders. Therefore, no single institution can address all these issues, and each agency must carefully examine its part of the process within its mandate while considering its effect on the whole. The Department of Justice has already implemented key reforms in evaluating and filing criminal cases. Meanwhile, the Department of the Interior and Local Government, through the Bureau of Jail Management and Penology (BJMP), has bolstered its paralegal and case-monitoring efforts to ensure release paperwork reaches a judge's desk as soon as a PDL completes their minimum sentence. Chief Justice Gesmundo stated that this synchronized coordination and reforms among the three agencies have reduced the national jail congestion rate by double digits. However, he added that decongestion cannot be regarded simply as a matter of administrative efficiency, emphasizing that behind every statistic is a person whose liberty is at stake, a family awaiting the return of a loved one, or an individual on the road to a new beginning.
