Tragic Electrocution in Vietnam: Tenant Deposit Refund Dispute Arises After Landlord Couple's Deaths

Following this unfortunate event, the buyer who had intended to purchase the house is now seeking the return of a deposit of 200 million VND (approximately $8,000 USD) that had already been paid. Lawyer Nguyen Trung Thanh has provided an analysis of this complex situation from both legal and humanitarian perspectives. Generally, a deposit in real estate transactions serves as a guarantee of contract fulfillment, and if one party cannot fulfill the contract, appropriate measures are taken based on their responsibility. However, in a unique circumstance like the unexpected death of the owner due to an accident, the return of the deposit cannot be determined straightforwardly. Legally, the key issue may be whether the cause of the contract's impossibility to be fulfilled is considered "force majeure," meaning it cannot be attributed to the fault of either party. Furthermore, buyers have a duty to conduct thorough inspections of the property's condition before finalizing a contract. On the other hand, for the bereaved family, considerations of the deceased's dignity, in addition to the financial burden of a sudden tragedy, should also be taken into account.
