SC Orders Congress to Enact Anti-Political Dynasty Law

The Supreme Court has ordered Congress to enact a law prohibiting political dynasties, ruling that its failure to do so for 39 years constitutes grave abuse of discretion. The ruling stems from consolidated petitions seeking to compel Congress to fulfill its constitutional duty. According to Supreme Court spokesperson Camille Ting, the phrase "as may be defined by law" in Article II, Section 26 of the 1987 Constitution makes it clear that the State has a mandatory duty to prohibit political dynasties. However, Congress retains the authority to define what constitutes a political dynasty and determine the scope of the prohibition. Akbayan Party-list Representative Chel Diokno welcomed the decision, calling it "groundbreaking." He stated that the anti-political dynasty bill his group is pushing for would ban relatives up to the fourth degree of consanguinity or affinity from running for or occupying a public post in the same constituency or jurisdiction. Diokno emphasized that all positions, whether local or national, should be covered by the prohibition. This proposed version differs from House Bill 8389, approved by the House of Representatives, which prohibits relatives up to the second degree of consanguinity or affinity from running for or occupying a post in the same constituency or jurisdiction. Diokno believes that an "Anti-Political Dynasty Bill with real teeth" would significantly reduce political dynasties.
