
Former Khanh Hoa Chairmen, Military Generals Face Prison for Land Misappropriation

The Military Region 5 Prosecutor's Office announced its indictment, seeking prison sentences for all nine defendants in connection with serious violations concerning land management. Two former Chairmen of Khanh Hoa province, Mr. Nguyen Chien Thang and Mr. Le Duc Vinh, face prison terms ranging from four to four and a half years. Similarly, two former major generals, Nguyen Duy Cuong, former principal of the Air Force Officer School, and Hoang Viet Quang, former deputy director of the Operations Department, have been indicted for directly violating land management regulations, with sentences sought between 30 and 36 months. Several other local officials, including former Vice Chairman Dao Cong Thien and former Director of the Department of Natural Resources and Environment Vo Tan Thai, also face similar charges. All these former local officials are currently serving sentences for other offenses. At the heart of the scandal is Mr. Nguyen Van Hau, chairman of the Phuc Son Group, a large-scale developer. He faces a severe sentence of 12 to 13 years for real estate fraud. His sister, Ms. Nguyen Thi Hang, former Deputy General Director, faces 7 to 8 years. Mr. Tran Huu Dinh, Director of Nam A Investment, faces 8 to 9 years. Hau has previously been sentenced to 30 years for illegal bidding offenses in multiple provinces. Ms. Hang received a 4.5-year sentence, and Mr. Dinh received a 3-year sentence in prior cases. In the civil verdict, the prosecution demanded that Hau compensate for all financial damages. While the court acknowledged the amounts paid by the defendants so far, Hau is still required to pay an additional 6,691 billion VND. The prosecution argued that the defendants engaged in sophisticated and reckless mismanagement of public assets, demonstrating blatant disregard for the law and causing severe consequences. The trial was conducted publicly by the Military Court of Region 5 to punish the guilty and educate the public on legal compliance. These crimes have significantly damaged the reputation of state institutions and undermined the local investment environment, leading to widespread public outrage and a loss of trust. "The defendants were well aware of the regulations but deliberately ignored them," the indictment stated. Their willful negligence allowed for the illegal transfer of land to Phuc Son Company. Systemic violations occurred between 2015 and 2024. Defense agencies had agreed to rezone the Nha Trang airport area for local economic purposes, but the official relocation plan had not yet been approved by the Prime Minister. Despite this, officials, including Thang and Vinh, along with the two major generals, circumvented legal procedures. They mismanaged the transfer of 186.2 hectares of military land to the province, violating legal processes and ignoring clear directives from the Prime Minister. As a result, nearly 63 hectares of state defense land were illegally handed over to Phuc Son Group, causing substantial state losses due to this criminal negligence. Phuc Son Group quickly capitalized on the situation. By June 2015, the province had issued initial certificates for hotel and housing projects, and the company immediately began mobilizing capital through investment contracts, even before official project plans were approved. By 2016, Chairman Nguyen Van Hau had issued illegal decisions and notices. He signed land transfer contracts with customers but almost immediately failed to fulfill his commitments. Investigators discovered that Hau had signed over 980 contracts with 683 buyers, collecting over 7 trillion VND from these victims. The company recorded nearly 6 trillion VND in its accounting books. Subsequently, Hau instructed his staff to falsify records and transfer 211 land plots to Mr. Tran Huu Dinh for resale at a profit.
