Thai Senators Criticize Former Constitutional Court Chief Over Remarks on Selection Process

A group of Thai senators has collectively responded to remarks made by Nakhonin Meklaitrat, a former Chief Justice of the Constitutional Court, who stated that the selection process for senators has diminished their political legitimacy. Pisit Apiwattanapong, a senator and spokesperson for the Senate's committee on legislative affairs, argued that Nakhonin's comments were a derogatory generalization that damaged the honor and dignity of all senators. Pisit also addressed Nakhonin's claim that Michai Ruchuphan, a former chairman of the Constitution Drafting Committee, admitted the senator selection system was a "worst mistake." However, Michai has explicitly denied ever meeting or discussing this matter with Nakhonin. Pisit therefore demanded that Nakhonin present evidence of such a conversation. Furthermore, Pisit asserted that Nakhonin's unsubstantiated claims constituted defamation of the constitution drafters, misleading the public into believing that senators lack constitutional authority. He questioned why Nakhonin, having served as a judge and chief justice of the Constitutional Court for 10 years, did not raise clear objections if he believed the Senate system was problematic during his tenure. The senators presented four demands to Nakhonin: to clarify the facts and provide evidence for his claims about Michai, to correct or clarify his statements to the public if he cannot verify them, to refrain from making generalized remarks that damage the Senate, and to respect the public's right to accurate and verifiable information. In response, Senator Pol. Maj. Gen. Chattawat Saengpetch urged Nakhonin to reflect on himself, stating that all institutions originate from the current constitution. He added that senators respect the work of all agencies, including the DSI and the Election Commission, but questioned the credibility and rule adherence of officials who disclose public information and documents, in the interest of national harmony.
