Jokowi's Degree Controversy: Doctor Tifa Faces Defamation Trial
A defamation trial against Doctor Tifa, who questioned President Joko Widodo's academic degree, commenced in Indonesia. Tifa claims the degree is 'fake,' while the president's side pursues legal action for defamation. The authenticity of Jokowi's university diploma is the central issue in the court proceedings.
The first hearing in the defamation case questioning President Joko Widodo's academic degree commenced at the East Jakarta District Court on Thursday (2/7). Tifauzia Tyassuma, alias Doctor Tifa, appeared in court, stating she was accompanied by 25 lawyers. "I am here at the East Jakarta District Court to fulfill the prosecutor's summons, along with my 25 advocates," Tifa said before the trial. She mentioned that her lawyers are part of the "Tim Pembela Dokter Tifa" (Doctor Tifa Defense Team) and are experts in law. During the hearing, Tifa was charged with criminal acts of slander and defamation related to her statements about the authenticity of President Jokowi's degree. The public prosecutor (JPU) argued that the defendant's statements contained untrue accusations. This is because Gadjah Mada University (UGM) has officially confirmed that President Jokowi is a graduate of UGM's Faculty of Forestry, in accordance with academic facts. However, the defendant continued to accuse his undergraduate (S-1) diploma of being fake through social media posts and talk shows. "Regarding the defendant's accusations against witness Jokowi, the defendant could not prove her allegations, and these accusations contradict what the defendant knows. Therefore, the defendant's actions constitute an attack on the honor of witness Jokowi using information technology means," stated the prosecutor. The prosecutor further explained that Jokowi was officially registered as a student at UGM's Faculty of Forestry on July 28, 1980. During his studies, he completed the required 160 credit units as stipulated in the 1982 Undergraduate Study Program Handbook. Consequently, UGM issued the Forestry Bachelor's Degree No: 1120 dated November 5, 1985, under the name Joko Widodo. The prosecutor asserted that Doctor Tifa's accusation of a fake diploma caused Jokowi "immeasurable non-material damages," including the defamation of his personal reputation. He felt "deeply insulted and utterly degraded," with some parties even accusing him of using a fake diploma to meet the requirements for public office, including his candidacies for Mayor of Solo, Governor of Jakarta, and the 7th President of the Republic of Indonesia. For her alleged actions, Tifa faces charges under Article 434 Paragraph 1 in conjunction with Article 441 Paragraph 1 and Article 126 Paragraph 1 of the Criminal Code (KUHP) as the primary charge. The subsidiary charge is under Article 433 Paragraph 1 in conjunction with Article 441 Paragraph 1 and Article 126 Paragraph 1 of the KUHP. Additionally, Tifa is charged under Article 434 Paragraph 1 of the KUHP as the primary charge for her second indictment. The subsidiary charge is under Article 310 Paragraph 1 of the KUHP, or Article 35 in conjunction with Article 51 Paragraph (1) and/or Article 32 Paragraph (1) in conjunction with Article 48 Paragraph (1) of Law Number 11 of 2008 concerning Information and Electronic Transactions, in conjunction with Article 126 Paragraph (1) of the KUHP, or Article 32 in conjunction with Article 48 Paragraph 1 of Law Number 11 of 2008 concerning Information and Electronic Transactions, in conjunction with Article 126 Paragraph (1) of the KUHP. During the hearing, after the prosecutor read the indictment, the panel of judges explained that provisions within the Criminal Procedure Code (KUHAP) allow the defendant to pursue restorative justice or reconciliation, given that the threat of punishment in the indictment is below five years. "So, defendant, based on the indictment read out, there are several articles that meet the provisions of Article 204 Paragraph 5, with a threat of less than 5 years. You can pursue or attempt reconciliation with the victim," said the judge. "If not, will you admit the indictment according to the provisions of Article 205 Paragraph 1 or Article 206 Paragraph 1, or will you file a defense?" the judge added. Tifa was then given time to consult with her legal counsel. She stated that she refused the restorative justice proposal. "So, based on my consultation with my advocates, first, I will not pursue restorative justice," Tifa said. "Second, I will file a defense. Third, I will not accept a plea bargain," Tifa stated. The judge then announced that the trial would continue on Thursday (9/7) of the following week. After the trial, Tifa reiterated that President Jokowi must show his original diploma, both in court and to the public. She believes that for Jokowi to prove her claims of defamation and slander, he must present the original S-1 diploma that has been the subject of dispute. "So, how can Mr. Joko Widodo prove that I have committed defamation, that I have slandered him? Mr. Joko Widodo must show his original diploma. Not just in court, but also to the public," Tifa said. President Jokowi's lawyer, Yakup Hasibuan, stated that his client is ready to attend the trial in the alleged defamation and slander case against Doctor Tifa. "We met directly with Mr. Jokowi yesterday, and he stated he is ready to attend," said Yakup after the indictment hearing. He mentioned that Jokowi would use the court forum to present his diploma. Hasibuan added that Jokowi has been attacked with various narratives in other forums. "Now we have the opportunity to present his diploma in this honorable forum, and Mr. Jokowi greatly respects that and is eagerly awaiting that time," said Yaqup. He also revealed that investigators had previously seized Jokowi's high school and undergraduate diplomas. Yaqup stated that Jokowi is prepared to attend with diplomas dating back to elementary school. "Because the diplomas that have been seized are high school and UGM. So, the prosecutor will certainly present those, and Mr. Jokowi will show them all. Moreover, he plans to bring his elementary and junior high school diplomas as well, so that no one questions it further," he said. Source: CNN Indonesia
