Vietnam's Land Law Draft Signals Policy Shift Towards Resource Maximization

The draft amended Land Law currently under consideration in Vietnam is expected to bring about a significant shift in policy thinking regarding land management and utilization. The draft clearly indicates a move away from traditional land management and control towards actively leveraging land as a crucial resource for economic development. A key highlight of the draft is the addition of a new principle: "Maximizing the potential, value, and resources of land, and eliminating unused or wasted land," alongside the existing principles of "sustainable, efficient, and effective land use." This strengthens the perspective of not only ensuring land is used "correctly" but also of enhancing its value and economic contribution. Furthermore, the draft proposes improvements to mechanisms for smoothly handling remaining land use rights when investors reach a certain level of agreement. It also clarifies that state land acquisition must serve "public interest for socio-economic development," aiming to promote development. Notably, the establishment of a circular mechanism where the state appropriately regulates land value appreciation and reinvests it into infrastructure development is crucial for expanding sustainable development spaces. Land use planning emphasizes "flexible implementation" based on verifiable data-driven criteria, rather than fixed directives. Regarding land incentives, the approach is shifting from "how much is the incentive?" to "how much economic and social value does each unit of land incentive generate?" This focuses on outcomes. Land pricing will also prioritize objectivity and transparency based on data, though its accuracy will heavily depend on data quality. These changes align with the directives of the Central Committee of the Communist Party of Vietnam, aiming to accelerate economic growth through the efficient utilization of land resources. However, to ensure the draft's effectiveness, it is essential to view the entire process of land acquisition, development, use, and management holistically, rather than assessing individual clauses in isolation. Delays in any single stage can impact subsequent processes such as investment, production, job creation, and value addition to the economy.
