DOE files supplemental complaint against Leviste, SPBC officials

The Department of Energy (DOE) has filed a supplemental complaint in the estafa charges against Representative Leandro Leviste and two other officials of Solar Para sa Bayan Corp. (SPBC). DOE Renewable Energy Management Bureau legal officer Atty. Gabriel Corpuz confirmed that the supplemental complaint was filed at the Taguig City Prosecutor’s Office. Corpuz declined to release a copy of the complaint, citing ongoing investigation by the City Prosecutor’s Office, but noted it relates to SPBC's failure to deliver the awarded capacity by December 2025 and to maintain the performance security required for the first Green Energy Auction (GEA). The DOE had previously filed a complaint with the Department of Justice (DOJ) against Leviste, Laguente, Flamiano, and other SPBC officials for alleged violations of the Public Service Act. The complaint indicated that it had no records or receipt of any application by SPBC for permits, licenses, approvals, authorizations, or similar regulatory consents to fulfill its obligation. Leviste has previously stated that the DOE’s allegations are baseless and a threat to public entities. Under Republic Act 11357, SPBC was granted a nonexclusive 25-year legislative franchise, which would be deemed revoked if SPBC fails to operate continuously for two years. Leviste, along with his mother, Senator Loren Legarda, is under investigation by the Ombudsman for plunder and graft complaints over the alleged failure of his renewable energy firm to provide solar power as required under its franchise.
