Vietnam Raises Construction and Real Estate Fines to Up to 1 Billion VND

The Vietnamese government has issued a new decree, Nghị định số 339/2026/NĐ-CP, stipulating administrative sanctions for violations in the fields of construction, management of technical infrastructure, housing management and development, and real estate business. This decree, effective from August 26, 2026, replaces the previous Nghị định số 16/2022/NĐ-CP. The key provision of the new decree is the significant increase in the maximum fine for violations, raising it to up to 1 billion Vietnamese Dong (approximately $58,000 USD). This measure is intended to enhance the deterrent effect against illegal activities within the construction and real estate sectors and to strengthen market transparency and discipline. In recent years, Vietnam has experienced rapid economic growth, leading to an expansion of its construction and real estate markets. However, this growth has also been accompanied by various violations, including unauthorized construction, failure to meet safety standards, and disregard for environmental regulations. Past incidents highlight the need for stricter enforcement. For instance, the Urban Planning and Construction Institute in Hue was penalized for illegally dismantling public property. In Ha Tinh province, irregularities in construction material testing came under police investigation. Furthermore, a deputy director of the Department of Construction was reprimanded for alleged violations in a resort development project near Tri An Lake, and all 14 construction projects under the Nam Giang Regional Construction Investment Project Management Board were found to have violations. Irregularities were also reported in the construction of the Can Tho Oncology Hospital. The increase in the maximum fine signals the government's firm stance against such misconduct and is expected to compel investors and developers in the construction and real estate sectors to adhere more strictly to legal regulations. Within Vietnam's one-party system, government policy decisions tend to be implemented swiftly, and this decree is seen as part of efforts to ensure the sustainability and soundness of economic development.
