West Java Chamber of Commerce Caretaker Replacement Legality Questioned Over Procedural Violations
The legality of the replacement of the caretaker for the West Java Chamber of Commerce and Industry is being challenged in court due to alleged procedural violations. An expert witness stated that decisions not following organizational rules could be deemed invalid, with the court to render a final judgment.
The legality of the replacement of the caretaker for the West Java Chamber of Commerce and Industry (Kadin Jabar) is being questioned in court. The Indonesian Chamber of Commerce and Industry (Kadin Indonesia) Decree Number 198, which appointed Taufan Eko Nugroho as the new caretaker replacing Agung Suryamal, is under scrutiny at the Bandung District Court. Constitutional expert Eki Sirojul Baehaqi, presented as a witness, testified that organizational decisions must adhere to the basic budget, household budget, and organizational regulations. He stated that if Decree Number 198 was not issued following these procedures, its validity could be challenged. Eki further highlighted the obligation to formally notify interested parties. According to him, if a decision involves a change of personnel and the replaced individual does not receive proper notification or contest it, the replacement may be considered legally invalid. The lawsuit was initiated by Nizar Sungkar, who was elected Chairman of the West Java Chamber of Commerce at the VIII Muprov held in Bandung on September 24, 2025. However, on the same day, another Muprov in Bogor elected Almer Faiq Rusydi as chairman, and Kadin Indonesia subsequently confirmed Almer. Nizar contends that his confirmation should have taken precedence and is seeking material and immaterial damages amounting to Rp 20 billion. Previously, the caretaker for West Java Kadin was established by Kadin Indonesia through Decree SKEP/030/DP/IV/2025 dated April 30, 2025. Internal disputes were discussed in a meeting in October 2025, where Kadin Indonesia Deputy Chairman Erwin Aksa pledged to help resolve the crisis. Additionally, the Bogor Muprov is also facing a lawsuit from the Garut and Indramayu regional Kadin at the South Jakarta District Court for alleged violations of the AD/ART (Articles of Association). While the expert's opinion was presented during the trial, the court is still examining the legality of the decree.
