Ex-Plant Industry Execs, Entrepreneurs Cleared in Garlic Cartel Case

MANILA, Philippines — The Sandiganbayan Fifth Division has acquitted two former Bureau of Plant Industry (BPI) officials and several entrepreneurs of graft charges in connection with the alleged manipulation of garlic prices. In a decision promulgated on Tuesday, the court said the prosecution failed to prove the accused’s guilt beyond a reasonable doubt. Among those acquitted were former BPI executive Rodolfo Dela Cruz and former BPI licensing and permit division chief Alan Yap. They were among the key figures charged in relation to the alleged "garlic cartel" that reportedly manipulated prices through unfair control over the import and distribution of garlic in 2014. The court ruled that the evidence presented by the prosecution was insufficient to prove that the accused conspired to gain undue advantage. Specifically, it was noted that crucial evidence proving the facilitation of import licenses or direct involvement in price manipulation was lacking. This acquittal highlights the stringent evidence standards required by the judiciary in prosecuting alleged corrupt practices and cartel activities within the agricultural sector in the Philippines.
