Indonesian Interior Minister 'Surprised' by Permit Requirement for Forest Fire Suppression

Indonesian Minister of Home Affairs Tito Karnavian expressed his "surprise" at the procedure requiring land owner permits for the suppression of forest and land fires (karhutla) in Kalimantan. He criticized such a procedure as being against the law, stating that those who demand permits are in the wrong. Speaking at a meeting with the House of Representatives Commission II on Tuesday (15/9), Tito stated, "I am a bit surprised that in places like Central Kalimantan or South Kalimantan, the firefighters have to ask for permission to enter the area." He explained that under disaster emergency conditions, the law allows for discretionary action in handling disasters, even on land owned by individuals or corporations, thus negating the need for permits. Furthermore, Tito added, "In a state of emergency, any discretion can be exercised to stop or prevent the disaster." He elaborated that in cases of fire, even private property can be entered, and if necessary, buildings can be demolished. He pointed out that not only the Disaster Management Law but also the Criminal Code contains provisions regarding good will access in emergency situations, where any action taken during an emergency can be forgiven.
