Thai government approves new rule for immediate deportation of foreigners committing 6 types of offenses

Yangon, July 15 It has been learned that the Thai government has approved a new regulation to enable the swift deportation of foreigners, including Myanmar nationals residing in Thailand, who commit six specified offenses. The regulation was approved during a cabinet meeting of the Thai government held on July 14, based on a draft deportation regulation from the Prime Minister's Office presented by Deputy Prime Minister Pakorn Nilprapunt. Government spokesperson Rachada Dhnadirek stated that previously, there were no specific administrative regulations regarding the deportation of foreigners, and therefore, this regulation was drafted to enable faster and more effective action against foreign offenders and illegal immigrants. The draft regulation specifies six types of offenses for which foreigners can be deported if deemed necessary for public peace and good morals. These include illegal entry or illegal stay in Thailand, illegal employment in violation of the Foreign Workers Law, illegal business activities in violation of the Foreign Business Law, forgery or use of forged government official documents, commission of offenses punishable by imprisonment for three years or more, and involvement as a principal offender, instigator, or supporter in the aforementioned offenses. This regulation will apply to all foreigners residing or working in Thailand, including Myanmar nationals, and they may face action under the deportation process if they commit the specified offenses. Before the release of a foreign national serving a prison sentence, the Director-General of the Corrections Department must notify the Permanent Secretary of the Ministry of Interior or their designated representative of the foreigner's name, nationality, case file, and evidence within a specified period. Subsequently, the case will be promptly submitted to the Minister of Interior for consideration and decision on issuing a deportation order, and the Ministry of Interior will be responsible for repatriating the deported person to their country of origin. For individuals whose nationality is not clearly established, they will be deported to the country they last declared as their place of residence before entering Thailand. Furthermore, if a third country or international organization, other than the deported person's nationality, wishes to accept the individual, a formal request must be made through diplomatic channels. All costs for care and repatriation must be borne by the receiving party before deportation, and the written consent of the deported person must also be obtained.
