PTUN Jakarta Rules Raja Ampat Nickel Mining Permit Revocation Data Publicly Accessible

Jakarta, Indonesia – On September 14, 2026, the Jakarta State Administrative Court (PTUN) ruled that information concerning the revocation of four nickel mining business permits (IUP) in Raja Ampat is public data. This decision upholds a previous ruling by the Information Commission dated June 10 of the same year. The PTUN Jakarta verdict, numbered 242/G/KI/2026/PTUN.Jkt, explicitly stated that the information related to these four IUPs constitutes public information and is not confidential. The court rejected the objection filed by the Ministry of Investment and Downstreaming/Investment Coordinating Board (BKPM), ordering the agency to pay court costs amounting to Rp419,000. Greenpeace Indonesia, which initiated the lawsuit to access this information, considers the ruling a significant victory in a months-long information dispute. Anggi Putra Prayoga, Forest Campaigner for Greenpeace Indonesia, stated that the court's decision aligns with public demand, emphasizing that all matters related to natural resource governance, especially permits, must be transparent. Prayoga expressed concerns that if such information remains closed, Raja Ampat faces a higher risk of further environmental degradation, and new permits might be issued without improvements in governance. Greenpeace is monitoring whether BKPM will file a cassation appeal within the legal timeframe. This decision is seen as a crucial advancement towards greater transparency in Indonesia's governmental decision-making processes.
